AbstractThis study looks at the ethical basis of rights toward using water in the South African society with respect to three principal legal forms: human right, contractual right, and property right, The mix of these three legal forms is now changing in new South Africa. These changes have come by partly to redress the inequity created in the past and partly due to a strong South African constitution which emboldens the human rights in the society. The study however cautions policy makers and planners toward obtaining a cost efficient and just solution.
